Employee's Compensation Act, 1923: What the Law Requires From Employers

The Employee's Compensation Act, 1923 (formerly the Workmen's Compensation Act) required employers to compensate employees for workplace accidents, occupational diseases, disability, or death arising out of and in the course of employment. 

Now, employers must also inform employees of their compensation rights, and delayed compensation may attract 12% annual interest and a penalty of up to 50%.

Note: The law makes compensation mandatory, not insurance. While employers are not legally required to buy a workmen compensation insurance policy, doing so is the most practical way to manage legal compensation obligations. In addition, many government contracts and businesses in sectors such as mining, manufacturing, and factories require employers to maintain workmen compensation insurance as a contractual or regulatory condition.

While the Employee's Compensation Act, 1923 does not make insurance mandatory, a workmen compensation insurance policy is strongly recommended for employers whose employees are not covered under the ESI scheme. It is particularly important for:

What Is Not Covered?

    • Injuries arising from war, invasion, or civil commotion.
    • Interest or penalties the employer pays for delayed compensation.
    • Contractor or subcontractor employees, unless specifically covered under the policy.
    • Compensation where the accident is directly caused by the employee being under the influence of alcohol or drugs, willfully disobeying a safety rule, or willfully removing a safety device. However, this exception does not apply if the accident results in death or permanent total disablement, in which case the employer remains liable.

Table A Versus Table B Cover Under the Workmen Compensation Tariff

The workmen compensation insurance policy tariff previously prescribed standard premium rates and policy structures. After the Tariff Advisory Committee (TAC) and IRDAI withdrew the administered tariff, the market is now de-tariffed. This means insurers determine premiums based on their own underwriting models, risk assessments, claims experience, and the employer's risk profile rather than fixed tariff rates.

How Workmen Compensation Insurance Premium Is Calculated on Declared Wages

The premium for a workmen compensation insurance policy is based on the employer's estimated annual wage bill, employee category, occupation, risk profile, and claims history.

Note: Don't confuse the average clause with premium adjustment. The average clause applies during a claim and can proportionately reduce the payout if wages or employee numbers were under-declared, leaving the employer to bear the shortfall. Premium adjustment is an annual reconciliation in which the premium is increased or refunded based on actual payroll.

At renewal, the insurer compares estimated payroll with actual payroll and adjusts the premium. Deliberately under-reporting wages or employees may be treated as information the employer failed to disclose, allowing the insurer to reject claims or even void the policy.

How to File a Workmen Compensation Claim?

Step 1: Report the Accident

Provide immediate medical assistance to the injured employee and record the incident details, including witness statements and photographs, if available.

Step 2: Notify the Insurer

Inform the insurance company as soon as possible and obtain a claim reference number and claim form.

Step 3: Obtain Medical Documentation

Arrange for a medical examination and collect relevant documents, including medical reports, treatment records, and disability certificates, where applicable.

Step 4: Submit Supporting Documents

Submit the completed claim form along with employee attendance and wage records, medical reports and bills, and, where applicable, the FIR, police report, death certificate, and legal heir documents.

Step 5: Claim Assessment and Settlement

The insurer will verify the claim, assess the compensation payable, and settle the claim if approved.

Note: Compensation for death and any lump sum payable to a woman or to a person under a legal disability such as a minor must be deposited with the competent authority. It cannot be paid directly to the employee or dependents. The competent authority then distributes it.

Workmen Compensation Insurance Versus ESIC: Which One Applies to Your Workers?

The Employees' State Insurance (ESI) Scheme and the Employee's Compensation Act, 1923 do not apply simultaneously for the same employee and workplace injury. Which one applies depends on whether the employee is covered under ESIC.

Does workmen compensation insurance cover gig and platform workers such as delivery riders?

No, not in their capacity as gig or platform workers. Under the Code on Social Security, 2020, gig and platform workers are governed by Chapter IX, while workmen compensation insurance covers liabilities arising under Chapter VII, which applies to employees. However, if you employ a delivery rider on your payroll as an employee, they may be covered under the policy. The same rider engaged as an independent gig worker through a platform is not covered.
